Terms of Use

thare health LLC (“thare health,” “we,” or “us”) owns and operates the websites located at thare.health and may in the future own and/or operate a “thare health” mobile application (collectively, the “platform”). Your access and use of the platform, any part thereof, or anything associated therewith, including its content (“content”), any products or services provided through the platform or otherwise by thare health, and any affiliated website, software, or application owned or operated by thare health (collectively, including the platform and the content, the “service”) are governed by these terms and conditions (“Terms and Conditions” or “agreement”). Although accessible by others, the service is intended for access and use only by U.S. customers.

Please read this agreement carefully before accessing or using the service because it sets forth the important terms you need to know. In this agreement, the terms “you” and “yours” refer to the person using the service.

THE SERVICE IS NOT APPROPRIATE FOR ALL MEDICAL CONDITIONS OR CONCERNS.

THIS AGREEMENT IS SUBJECT TO CHANGE AS PROVIDED HEREIN.

We may update these terms at any time by posting the updated version on the platform and updating the “Last Updated” date. By continuing to access or use the service after changes are posted, you agree to the revised agreement.

Acceptance of Terms and Conditions

By using the service, you agree to be bound by this agreement and all applicable laws and regulations. If you do not agree, you must discontinue use of the service immediately. We reserve the right to revise, restrict, or remove any part of the service at any time without notice.

Your Relationship with Us

thare health is a technology platform that connects users to licensed medical providers, pharmacies, and other vendors offering healthcare products and services—including hair loss treatments—through the service.

Our platform provides access to prescription fulfillment services offered by licensed pharmacies (the “Pharmacies”), such as ChemistryRX, 950 Henderson Blvd. Folcroft, PA 19032, and connects you with medical groups and their providers (“Medical Groups” and “Providers”). One of these independent medical groups is Beluga Health, P.A., a Florida professional corporation with its office located at 1321 Upland Dr., Suite 18399, Houston, TX, 77043 (“Beluga”). Beluga and its licensed healthcare providers are solely responsible for the medical care and clinical services they deliver.

We do not control or interfere with the practice of medicine by these independent medical groups or providers, who are solely responsible for the care they deliver. By using the service, you acknowledge that thare health is not a healthcare provider and that using the platform does not create a doctor–patient relationship between you and thare health.

Communications and Responsibilities

By using the service, you consent to receiving messages, reports, and recommendations from Providers or Medical Groups via the platform. You are solely responsible for reviewing and responding to these communications. thare health is not liable for any consequences resulting from your failure to review or follow such recommendations.

Financial Responsibility

thare health, the Medical Groups, and Pharmacies are not enrolled with federal, state, or private insurance programs, including Medicare or Medicaid. By using the service, you agree to obtain services on a cash-pay basis only and acknowledge you are fully responsible for payment.

Subscription Products

Some products, including certain hair loss treatments, are available on a subscription basis. Subscriptions automatically renew at the stated intervals unless canceled at least forty-eight (48) hours before the renewal date by contacting help@thare.co.

If your subscription includes provider consultations or prescription products, your total subscription price will include charges from the Medical Groups and Pharmacies, which we collect on their behalf.

Compounded Drugs

Some prescription products may be compounded drugs not reviewed by the FDA for safety, efficacy, or quality. FDA-approved alternatives may be available, and you are encouraged to discuss options with your provider.

Prescription Products

Prescription products require a valid prescription from a licensed provider. If deemed appropriate after consultation, your prescription can be filled through one of our partner pharmacies or any pharmacy of your choice.

Limited Use and Availability

The service is only available to individuals:

  1. Located in states where we operate,
  2. At least eighteen (18) years of age or the age of majority in their jurisdiction,
  3. Who agree to comply with this agreement and all applicable laws.

Availability may vary by state due to regulatory requirements.

Telehealth Services & Consent

Telehealth involves delivering healthcare remotely using electronic communications. It has benefits but also limitations, and it may not be appropriate for all conditions. By using the service, you consent to telehealth treatment as described in the Patient Consent provided by your medical group or provider.

thare health is a third-party beneficiary of the Patient Consent agreement and may enforce its terms.

Open Payments Notice

The Physician Payments Sunshine Act requires reporting of certain payments from drug or device manufacturers to healthcare providers. This data is publicly available at the Open Payments website (https://openpaymentsdata.cms.gov/).

Technology and Access

You are responsible for obtaining and maintaining the devices, software, and connectivity necessary to use the service and for all related costs, including internet and mobile fees.
